Joe O'Leary was instructed to represent an experienced Operating Department Practitioner (ODP) in misconduct proceedings before the Health and Care Professions (HCPC) Tribunal. The Registrant was alleged to have made a medication error in relation to a controlled drug, and also to have used inappropriate language on social media.
At the close of the HCPC’s case, Joe made a successful half-time submission arguing that there was no realistic prospect that the Panel could make a finding of misconduct against the Registrant.
The Panel agreed with Joe’s submissions and dismissed the case.
