Mark Smith was successful on appeal before Mrs Justice Williams challenging a Hungarian extradition request. The judge agreed that the dual criminality test was not satisfied for forgery offences and for using copyrighted material without permission that was said to amount to an offence under the Computer Misuse Act 1990.
