This article summarises a judgment in a financial dispute during a divorce. A couple made competing applications for the sale of a £42 million house and a €35.5 million yacht. The husband wanted to sell the house to discharge the mortgage, which the wife resisted, claiming she had a beneficial interest in the house, while the wife sought to sell the yacht to cover the mortgage. The court ruled in favour of selling the house while rejecting the wife’s bid to sell the yacht by reason of a claim by a third party, a company registered as the owner, that claimed also beneficial ownership. The wife and children were permitted to remain in the house until it was sold.
