Ben Keith obtained damages and redress for a former police officer whose home was searched and property seized by the Police. The search warrant was quashed by the High Court, all property seized was returned, all data obtained regarding the claimant’s bank accounts were deleted, and the Police force paid damages to the former officer, as well as his legal costs.
The Police obtained the search warrant by arguing that the former officer was suspected of having committed a number of serious offences related to corruption of current officers. Ben was instructed on a direct access basis. He issued judicial review proceedings against the Police force in the High Court. The case was settled by consent after the Police accepted that the warrant was obtained illegally.
