On 16th July 2019, Mr Justice Nichol allowed the extradition appeal of Poland v Matwiejow on s.10 grounds. He was persuaded that the dishonesty offence in the EAW was not an extraterritorial offence and rejected the District Judge’s findings that any harm associated with the offence took place in Poland. Further he found that the Judicial Authority had not proved the mens rea element of the offence to the criminal standard.
