Eleanor Stephenson, instructed by Enrico Braguglia and Katy Smart of Sonn Macmillan Walker, secured the discharge of her client, who was wanted by Poland in relation to fraud offences.
Her client was the father of three young children, who had recently been returned home following a period in local authority care. Expert evidence demonstrated the children’s particular vulnerability to further separation, including the likely short- and long-term impact that extradition would have on them.
Eleanor argued that this was one of those rare cases in which extradition would constitute a disproportionate interference with the Article 8 rights of her client and his family.
The Judge agreed and ordered her client’s discharge.
