Amy Woolfson secured a discharge for a man wanted to serve a sentence of 17 months’ imprisonment in Romania.
He was the sole carer to three teenage sons, though he had supportive family living nearby. The Judicial Authority argued that he was a fugitive as the warrant indicated that he had been personally summonsed to attend his trial.
Amy was able to persuade the District Judge that despite the clear statement on the warrant, the requested person was not a fugitive. She successfully argued that extradition would be a disproportionate interference with the requested person’s and his sons' Article 8 Rights.
