Ben Keith has been instructed to represent Patrick Balahan before the European Court of Human Rights.

Mr Balahan faces extradition from Sweden to the United States of America. He is requested to stand trial in California in relation to allegations of (1) aggravated mayhem, (2) torture and (3) grand theft. The European Court of Human Rights in Strasbourg has ordered under Rule 39 that his extradition should be stayed pending further argument.

On 20 December 2022 submissions were made to the Court in relation to the questions posed about life without parole and grossly disproportionate sentences in the US. This case follows on from the case in which Mr Keith acted of Sanchez-Sanchez v United Kingdom in which the Grand Chamber of the European Court of Human Rights clarified the law on life without parole and extradition.

Barrister Ben Keith was instructed by Roger Sahota at Berkley Square Solicitors in this case and the case of Sanchez-Sanchez.
