David Josse QC and Ben Keith have obtained a Rule 39 injunction preventing the extradition of their client to the United States of America until the European Court of Human Rights finally decides the case.

The Divisional Court dismissed the appeal of their client in Sanchez v United States of America [2020] EWHC 508 (Admin). However, the ECtHR granted the injunction and has set down an initial timetable for the case. The ECtHR will examine whether it is a breach of Article 3 ECHR to extradite to the US Federal system where the requested person faces a sentence of life imprisonment without parole (an irreducible life sentence).
