Hannah Pye acted as junior for the Swedish judicial authority in the case of Julian Assange v Swedish Public Prosecutor in the Supreme Court [2012] UKSC 22. It was argued on behalf of Julian Assange that the European arrest warrant upon which his surrender to Sweden was sought was invalid as it had been issued by a Public Prosecutor who was not a judicial authority as required by the Extradition Act 2003. It was found by a majority of the Supreme Court that a judicial authority for the purposes of the Extradition Act 2003 and the Framework Decision on the European arrest warrant held a meaning that was wider than a court or judge and properly encompassed the Swedish Public Prosecutor. The order for Julian Assange’s extradition to Sweden to face criminal proceedings in relation to allegations of sexual offences was upheld.
