Divisional Court gives judgement in extradition EAW suicide risk cases

On 30 January 2013 the Divisional Court of Sir John Thomas President QBD and Burnett J set down guidelines on the interplay of suicide risk and oppression under s25 of the Extradition Act 2003. It was held that it will be very rare that a Defendant will be likely to establish that measures to prevent a substantial risk of suicide will not be effective and therefore prevent extradition.
