Extradition

The Extradition Act 2003 has dramatically changed the extradition process, particularly in regard to EU member states. Though it was meant to streamline the process, in reality, it has introduced new complications that require careful consideration. The growth of international crime has created a need for accomplished extradition barristers.

Members of Chambers have earned reputations as leading practitioners in the extradition field. They regularly provide advice, guidance and representation in extradition matters to requesting authorities, defendants and foreign governments.

The fast-moving pace of extradition actions requires barrister involvement from the very outset of a case, often within 24 hours. They provide expert advice representation to clients from the start of a case to its conclusion.

Members deal with matters such as:

  • Advice and representation on European Arrest Warrants for Category 1 territories
  • Advice and representation on requests from Category 2 territories and those with whom the UK has ad hoc extradition arrangements
  • Appeals against extradition and the Secretary of State for the Home Department
  • Preparation of applications by Defendants to the High Court for habeas corpus and judicial review proceedings
  • Advice and representation of defendants and foreign governments in proceedings before the Supreme Court and European Court of Human Rights

After extradition to the UK, prosecution and representation of defendants accused of serious crimes.
